Printing processes.
Fabric composition.
Garment dyeing or pigment dyeing.
Manufacturing variations.

For garment-dyed or pigment-dyed products, natural shade variations may occur and are part of the characteristics of the garment.

Printed designs may also have small variations in placement, texture, saturation, size, or appearance resulting from the printing and manufacturing process.

Such normal manufacturing variations are not necessarily considered defects.

5. SIZING AND FIT

Sizing information provided on the Site is intended as a general guide.

Fit may vary depending on:

Manufacturer.
Fabric.
Garment dyeing.
Production batch.
Individual body proportions.
Washing and drying methods.

Customers are responsible for reviewing the applicable size guide before purchasing.

Where applicable, product descriptions may identify a garment as fitted, relaxed, oversized, boxy, cropped, slightly cropped, or another specific fit.

Natural cotton fibers may shrink after washing, particularly when exposed to heat.

We recommend following the care instructions provided for each product.

6. HANDMADE AND UNIQUE PRODUCTS

Certain Checkers & Thread products, including handmade items such as kimonos or limited-production pieces, may contain minor variations in:

Pattern placement.
Measurements.
Stitching.
Fabric placement.
Texture.
Finish.

These variations are characteristics of handmade or small-production items and do not necessarily constitute defects.

7. PRODUCT INFORMATION

We attempt to ensure that product descriptions, pricing, sizing, specifications, and other information appearing on our Site are accurate.

However, typographical errors, inaccuracies, or omissions may occasionally occur.

We reserve the right to correct errors, update information, or cancel an affected order where permitted by law.

If an order is canceled after payment has been collected, the applicable amount will be refunded.

Prices displayed on the Site are shown in the currency indicated at checkout.

We may change product prices at any time without prior notice.

Price changes will not normally affect orders already accepted, except where an obvious pricing or system error has occurred and applicable law permits correction.

13. PAYMENT

Payment must be successfully authorized before an order can be processed.

Payment services may be provided by Shopify Payments or other third-party payment processors.

We do not necessarily receive or store your complete payment card information.

Payment providers may independently process information according to their own terms and privacy policies.

We reserve the right to cancel an order when payment cannot be verified or authorized.

If tracking information shows that a package was lost or damaged during transit, please contact us so that we can review the situation and, where appropriate, assist with a carrier claim or other remedy.

Where tracking information indicates delivery but the customer cannot locate the package, the customer should promptly contact the carrier and Checkers & Thread.

Any responsibility for lost, stolen, misdelivered, or damaged packages will be determined according to applicable law, carrier procedures, and our Shipping Policy.

Nothing in these Terms eliminates any rights you may have under applicable consumer protection law.

18. INTERNATIONAL ORDERS

International customers may be responsible for:

21. CARE OF PRODUCTS

Customers are responsible for following garment care instructions.

Depending on the product, recommended care may include:

Washing in cold water.
Washing separately on the first wash.
Washing inside out.
Using non-chlorine bleach only when necessary.
Tumble drying on low heat.
Avoiding excessive heat.
Following garment-specific instructions.

Damage resulting from improper washing, drying, ironing, bleaching, alterations, misuse, or failure to follow care instructions may not qualify as a manufacturing defect.

22. PERSONAL USE

Unless otherwise authorized by Checkers & Thread, products and Site content are offered for personal, non-commercial use.

Purchasing products does not grant you the right to reproduce or commercially exploit Checkers & Thread designs, artwork, photography, branding, logos, or other intellectual property.

23. INTELLECTUAL PROPERTY

The Site and its contents, including without limitation:

Checkers & Thread branding.
Logos.
Product designs.
Original artwork.
Graphics.
Photographs.
Illustrations.
Product names.
Copy.
Website design.
Layout.
Videos.
Packaging designs.
Marketing materials.

are owned by, licensed to, or otherwise used with authorization by Checkers & Thread and are protected by applicable intellectual property laws.

You may not reproduce, copy, modify, distribute, publish, sell, license, commercially exploit, or create derivative works from protected Checkers & Thread content without prior written permission.

24. PROHIBITED USES

You may not use the Site or its content:

For unlawful purposes.

31. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHECKERS & THREAD AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW:

LOSS OF PROFITS.
LOSS OF DATA.
BUSINESS INTERRUPTION.

These limitations do not apply where prohibited by law and do not exclude liability that cannot lawfully be excluded.

32. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Checkers & Thread and its owners, affiliates, employees, contractors, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from:

Your unlawful use of the Site.
Your violation of these Terms.
Your infringement of third-party rights.
Fraudulent or malicious conduct attributable to you.

This provision does not apply to the extent a claim results from the wrongful conduct of Checkers & Thread or where indemnification is prohibited by applicable law.

We will not be responsible for delay or failure to perform obligations caused by events beyond our reasonable control.

34. CHARGEBACKS AND PAYMENT DISPUTES

Submitting knowingly false information in connection with a payment dispute or chargeback may constitute fraud.

Nothing in this section restricts a customer’s lawful right to dispute a transaction through a payment provider or financial institution.
